Ewa Sokola has filed a defamation lawsuit against Kaja in Manhattan federal court, claiming that Kaja's public statements have resulted in significant harm to her reputation and business as a cardiologist in Poland. The lawsuit alleges that Kaja made false statements that subjected Ewa to public hatred, shame, and disgrace in Wrocław, Poland. In June, a jury delivered a split verdict in Weinstein's trial, convicting him of forcibly performing oral sex on production assistant Miriam Haley, while acquitting him of charges related to Kaja. Both women alleged they were assaulted in 2006. Following the proceedings, the judge declared a mistrial on a separate charge against Weinstein after jurors reported being intimidated into conviction by their peers. A ruling on the defense's request to dismiss the verdict is expected from Judge Curtis Farber on January 8, 2026.

Kaja Sokola maintained that her sister's testimony undermined her own claims of sexual assault at the hands of Weinstein, which she states took place just before her 20th birthday. Kaja had been brought to Los Angeles by Weinstein for a brief role in the film "The Nanny Diaries." After a meeting with Weinstein, she testified that he led her to his hotel room with the pretext of discussing a script, where he subsequently assaulted her.

Following the trial, Kaja publicly criticized Ewa’s testimony, declaring that instead of aiding the prosecution, Ewa’s statements inadvertently supported Weinstein by providing his lawyers with evidence from a journal that described previous sexual assaults but did not mention Weinstein's actions. The lawsuit indicates Kaja's assertions include accusations of homicide, theft, falsifying medical records, and immoral conduct concerning Ewa, along with unfounded claims of collusion with Weinstein's defense team.
